Here are the Frequently Asked Questions that we encounter from Hiring Managers with regards to "trying out" Job Applicants before hiring them.
Q: What does the TrialByHire.com service cost?
A: There are two types of charges for our service:
- There is a one time, $199 Processing Fee per Job Applicant you wish to "try out." [This fee covers our legal and administrative costs to generate employment documents and an employment contract for your Job Applicant. It also covers the cost of a criminal background check, Social Security Number (SSN) verification, and address history check for the Applicant. There are no other Processing Fees unless you order additional background checks on the Applicant (pricing listed below). We will invoice you the $199 when you instruct us to hire your Job Applicant as our Contract Employee.]
- We charge a small Hourly Service Fee for each hour your Job Applicant works as our Contract Employee. This small, hourly fee is based on an in-house proprietary formula that calculates the risk we are taking, and it has already been included in the hourly rates that are displayed to you in the Hourly Employment Calculator.
Q: When I decide to hire the Job Applicant, does TrialByHire.com charge any kind of "buy out" fee at the end of the assignment?
A: No, there is no "buy out" fee, no placement fee, and no fee of any kind to terminate our contract early. If you decide that you want to hire your Job Applicant as your employee, you may do so at any time with no additional fee to us. We simply request that any outstanding invoices are paid in full at that time.
Q: Who will be the legal employer of the Job Applicant I wish to "try out"?
A: TrialByHire.com is a service of Top Echelon Contracting, Inc. As such, Top Echelon Contracting will be the W2 employer for your Job Applicant's during their "test drive" period. (fyi, Top Echelon Contracting has placed over 12,000 temporary/contract employees in 49 states since 1992, so we're not new at this.)
Q: Who takes care of the employment paperwork (e.g., W-4 form, Form I-9, etc.)?
A: TrialByHire.com will handle all necessary employment paperwork to "try out" your Job Applicant. This paperwork includes an Employment Contract for the Applicant, Background Check Authorization Form, W-4 Form, Form I-9, various payroll and time sheet instructions, and forms for providing your Job Applicant with benefits while they are our Contract Employee ( Employee Benefits Overview)
Q: How soon can the Job Applicant start to work at my company?
A: After you complete the Employer Login process and instruct us to begin, it will take approximately 3-5 business days before a candidate will be able to start to work. This time is necessary for the paperwork to be distributed to Job Applicant and returned to TrialByHire.com. The standard background checks will also be completed during this time delay. Please note this is an estimated time frame and may vary based on each situation.
Q: How long is the "Try Out" period?
A: Typically, your Job Applicant's trial period will be set up to run 90 days, however, the length of the assignment is your decision. You may end the assignment early (without penalty to you), or you may extend the assignment by simply contacting our office.
Q: If I am undecided about hiring my Job Applicant, can I extend the "Try Out" period longer than 90 days?
A: Yes, you may extend the Job Applicant's trial period by a number of monthly increments. Simply notify TrialByHire.com so the proper paperwork can be created.
Q: If I am unhappy with the Job Applicant's performance, how do I terminate the "Try Out" period?
A: If at any time you wish to terminate the "Trial Period," simply call our Human Resources Department (888-627-3678 ext. 491), and our HR Administrators will notify the employee of their immediate dismissal.
Q: What if I don't have Job Applicant for this position? Can you help me find one?
A: No, TrialByHire.com does not provide Job Applicants or Job Candidates to you. We do not recruit. If your assignment is a tough one that requires some recruiting expertise, we suggest that you visit www.RecommendedRecruiter.com for a list of quality Recruiters and Search Firms.
Q: Will TrialByHire.com conduct background checks on our Job Applicants?
A: Yes, TrialByHire.com automatically does a criminal background check and a Social Security Number verification with address history on all of our employees. (Results are required prior to your Job Applicant starting work.) You may also order any of the following "optional" background checks to be performed on your Job Applicant at the Processing Fees listed below:
- Education Verification ($12 per institution, with a $36 maximum)
- Employment Verification ($12 per employer, with a $60 maximum)
- Drivers License Check ($18 per state)
- Credit Report ($15)
- Professional License Verification ($3)
- Criminal Super Search ($30, National Criminal Search with SS Number Verification, National Sex Offender Search - includes sexual offenders and inmate records)
Q: Will TrialByHire.com conduct Drug Screenings?
A: If you would like a drug screen on your Job Applicant, a Chain of Custody Form will be sent to the Applicant. (Results are required prior to the candidate starting work.) Your cost for ordering a "Nine Panel Drug Screen" would be $35.
Q: How are timesheets handled?
A: TrialByHire.com is a service of Top Echelon Contracting, Inc., and we will therefore give timesheet instructions to each employee with his/her employment paperwork. The timesheets must be signed by both the employee and your company in order for TrialByHire.com to process the weekly payroll. TrialByHire.com's payroll deadline is each Monday by 1pm Eastern Time.
Q: How does invoicing/payment work?
A: We offer two payment options depending on your credit score. (We will check your company's credit score when you ask us to hire your Job Applicant as our Contract Employee.) If your credit score meets our standards, you can pay our invoices by company check. If your credit score is below our comfort level, we will require ACH debit payments.
Invoices are generated weekly and are payable net 15. Invoices are computed simply by multiplying your Company Bill Rate times the number of hours the Contract Employee works. (If Job Applicant is non-exempt, overtime will be calculated at 1.5 times the employee's hourly pay rate.) Sales tax may be added where applicable.
Q: When will the employee be paid?
A: Your Job Applicant (our employee) will be paid on a weekly basis, provided he/she meets our Monday payroll deadline. Paychecks are mailed to the employee’s home address each Thursday afternoon, however, direct deposit is recommended. Monies are deposited into the employee’s bank account each Friday.
Q: What benefits are available to the Job Applicant once hired? Is there a waiting period?
A: Each of the Job Applicants you wish to "try out" will be offered the following employee benefits: medical, dental, vision, and life insurance (see our Employee Benefits Overview). Your Job Applicant will be eligible to receive these benefits on the 1st of the month after he/she has worked for 30 days.
Q: Who is responsible for liability/Workers’ Compensation coverage for the employee?
A: TrialByHire.com is a service of Top Echelon Contracting who becomes the W2 employer for the Job Applicant. Therefore, we maintain the liability and Workers’ Compensation coverage.
Q: What insurance does Trial By Hire (or Top Echelon Contracting) carry?
A: Top Echelon Contracting carries a comprehensive Certificate of Insurance (available upon request). This package includes the following:

$1,000,000 – Hired and Non-owned Automobile Liability
$5,000,000 – Excess Liability
$1,000,000 – Employer’s Liability
$1,000,000 – Professional Liability
$1,000,000 – Employee Dishonesty Bonding
$25,000 – Forgery Bonding
Q: How are unemployment claims handled?
A: TrialByHire.com and Top Echelon Contracting handle all unemployment claims for terminated employees. The claim goes against Top Echelon Contracting's exposure rating and not your company.
Q: Who is responsible for payroll taxes?
A: TrialByHire.com is a service of Top Echelon Contracting who maintains responsibility for government compliance on its employees. Top Echelon Contracting is responsible for all payroll taxes, withholdings, filings, payments, registration, reconciliations, reports, and deductions including: Federal & State Withholding, Social Security, Medicare, Federal & State Unemployment, State Disability Insurance (where applicable), Workers’ Compensation, State Registration, Corporate Taxes and W-2 Forms.
Q: Will I need an attorney to decipher TrialByHire.com's "User Agreement"?
A: No, TrialByHire.com's User Agreement is straight forward and easy to read. There are no hidden "strings attached." After you create your Employer Login, you will be asked to acknowledge that you've read the Agreement and agree to its terms. You will only need to read and "click thru" this Agreement one time, so future hires through TrialByHire.com will be even easier!
